包头市城市绿化条例
第一章总则
第一条为了加强城市绿地建设和管理，保护绿地，改善城市景观环境，促进宜居城市建设，根据国务院《城市绿化条例》以及有关法律法规，结合本市实际，制定本条例。
第二条本条例适用于本市城市规划区内公园绿地、单位附属绿地、居住区绿地、防护绿地、生产绿地、道路绿地、其他绿地等城市绿地的规划、建设、保护和监督管理。
第三条城市绿化坚持政府主导、社会参与、科学规划、保护优先、因地制宜、讲求实效的原则。
第四条市、区人民政府应当将城市绿化事业纳入国民经济和社会发展规划，将城市绿化经费纳入同级财政预算。
第五条市、区人民政府应当科学组织城市绿化，提高城市绿化覆盖率和绿地标准，严格管理城市绿地，杜绝侵占城市绿地行为。
第六条市人民政府城市绿化行政主管部门(以下简称市绿化主管部门)负责本市城市绿化工作，并可以委托市园林绿化管理机构实施具体绿化工作。
昆都仑区、青山区、东河区、九原区人民政府按照市人民政府确定的职权范围，负责所辖区域内的城市绿化工作。
稀土高新技术产业开发区管委会按照市人民政府的规定负责所辖区域内的城市绿化工作。
市、区绿化主管部门对各单位的绿化建设、维护、管理进行监督检查，并给予技术指导。
发展和改革、财政、规划、国土资源、水务、交通运输、林业、住房保障和房屋管理、城市管理行政执法等部门在各自职责范围内，做好城市绿化相关工作。
第七条任何单位和个人都有权制止、投诉和举报损毁植物和绿化设施的行为;有权投诉和举报绿化主管部门、规划主管部门和城市管理行政执法部门在绿化管理方面的行政不作为和其他违法行为。
第二章规划和建设
第八条市绿化主管部门应当会同市规划主管部门，依照国民经济和社会发展规划，编制本市城市绿地系统规划，报市人民政府审批后纳入市城市总体规划。
城市绿地系统规划报批前，编制部门应当将规划草案予以公示，并采取论证会、听证会或者其他形式征求有关部门、社会公众和专家的意见。
第九条城市绿地系统规划应当与土地利用总体规划、林业规划、水资源规划、环境保护规划等相衔接。
第十条编制城市绿地系统规划，应当确定绿化目标和布局，规定各类绿地的控制原则;按照规定标准确定绿化用地面积，分层次合理布局绿地;按照普遍绿化与重点绿化相结合的要求，形成完整的城市绿化体系。
第十一条市规划主管部门应当会同市绿化主管部门按照城市绿地系统规划和本条例规定的原则，在编制控制性详细规划中，确定城市绿地建设规划，报市人民政府审批。
城市绿地建设规划应当确定绿化用地的界线和具体坐标。城市绿地建设规划确定的城市绿地应当向社会公布，并接受监督。
第十二条市、区绿化主管部门按照城市绿地系统规划和城市绿地建设规划，编制城市绿地建设年度计划，并组织实施。
第十三条城市绿化建设实行绿地率指标控制，应当按照下列标准确定：
(一)城市新建区绿地率应当不低于百分之三十八;
(二)改建区绿地率应当不低于百分之二十八;
(三)苗圃、花圃等生产绿地总面积应当不低于城市建成区总面积的百分之二。
第十四条城市公园绿地布局应当坚持绿地面积与位置统筹安排、分层次合理布局的原则。
新建区应当按照下列原则确定：
(一)五百米直径内应当至少规划建设一处一千平方米以上的公园绿地;
(二)一千米直径内应当至少规划建设一处五千平方米以上的公园绿地;
(三)二千米直径内应当至少规划建设一处一万平方米以上的公园绿地。
改建区参照前款规定执行。
第十五条城市各类建设项目，应当配套安排相应的绿化用地，其所占建设用地面积的比例应当为：
(一)道路绿地：园林景观路绿地率不得小于百分之四十，红线宽度大于五十米的道路绿地率不得小于百分之三十，红线宽度在四十至五十米的道路绿地率不得小于百分之二十五，红线宽度小于四十米的道路绿地率不得小于百分之二十;
(二)居住区绿地：新开发建设的居住区不低于百分之三十，改造的居住区不低于百分之二十五;
(三)单位附属绿地：新建中小学校、商业中心不低于百分之二十，大中专院校不低于百分之三十，机关团体、事业单位、部队、医院及公共文化场所不低于百分之三十五，其他单位附属绿地不低于百分之三十，改建的原单位附属绿地面积低于上述标准的，可以比照上述新建单位附属绿地的比例降低百分之五;
(四)其他绿地：按照《城市用地分类与规划建设用地标准》、《公园设计规范》等标准要求执行。
第十六条建设项目因用地面积不足，不能按照规定配套安排相应的绿化用地，需经市人民政府批准，建设单位应当缴纳绿地补偿费。收取绿地补偿费的具体办法由市人民政府规定。
第十七条市规划主管部门在审查各类建设项目时，应当按照国家有关规定和本条例规定的城市绿地指标，确定建设项目附属绿化用地的面积、位置等，并将其作为规划许可的内容;市建设主管部门在做出施工许可前，应当将建设项目附属绿化工程作为报审工程施工许可内容予以审查。
第十八条城市各类绿化工程设计方案，按照基本建设程序审批时，应当经市绿化主管部门审核同意。市绿化主管部门应当在五个工作日内提出审核意见。
市绿化主管部门的审核意见应当包括以下内容：
(一)绿地面积是否符合规定标准;
(二)绿地布局是否合理;
(三)植物的种类、配置是否适当;
(四)绿化设计是否符合园林景观要求;
(五)绿地内道路、给排水以及其他设施的设计是否符合有关园林设计规范。
第十九条建设单位应当按照批准的绿地面积、位置进行绿化工程建设。
建设项目附属绿化工程应当与主体工程同步规划、同步设计、按期建设。绿化工程应当按照审核同意的绿化工程设计方案进行施工。绿化工程的完成时间不得迟于主体工程竣工后的第一个绿化季节。
第二十条城市各类绿化工程应当进行竣工验收。市规划主管部门应当对建成的附属绿化用地面积和位置进行规划核实。建设单位应当组织绿化工程的设计、施工、工程监理等有关单位对附属绿化工程进行验收，并应当通知市绿化主管部门参加;将验收结果载于绿化工程竣工验收报告，按照有关规定报市绿化主管部门备案。
城市绿化工程竣工后，有关资料应当纳入城市建设档案进行管理。
第二十一条城市绿地按下列职责进行建设：
(一)公园绿地、道路绿地、防护绿地、生产绿地由绿化主管部门负责;
(二)单位附属绿地由本单位负责;
(三)居住区绿地由建设单位负责。
前款规定以外的绿地建设责任不明确的，由绿化主管部门负责。
第二十二条绿化工程的勘察、设计与施工、监理，应当委托具有相应资质等级的单位承担，并严格执行国家和自治区的相关技术规范和标准。
承担绿化工程勘察、设计与施工、监理的单位，应当按照资质等级承担相应的绿化工程，不得无资质或者违反资质标准超越等级承担绿化工程的勘察、设计与施工、监理。
第二十三条建设单位应当在公园绿地、居住区绿地和单位附属绿地醒目的地方设置绿地平面图。已建成的公园绿地、居住区绿地和单位附属绿地平面图由城市绿地管护单位负责设置。
第二十四条城市绿化应当按照兼顾景观与生态效应和有利于生长、养护的原则，选择适合本地气候、土壤条件的植物。
鼓励立体绿化、屋顶绿化等多种形式的绿化，鼓励对露天停车场地面进行绿化。
第二十五条绿化建设和管理维护，应当兼顾市政公用设施、水利工程、道路交通和消防等方面规划、建设和养护的需要。
修建城市道路或者敷设通讯、输电、燃气、热力、上下水管道等市政公用设施影响城市绿地及其设施的，在设计中和施工前，有关单位应当会同绿化主管部门确定绿化保护措施。
第二十六条市、区人民政府应当将财政预算安排的绿化经费，用于城市公益性绿化建设、监督管理和维护，并随城市绿化面积和管理维护费用的增加而相应增加。
第三章保护和管理
第二十七条本市实行城市绿线管理制度。
本条例所称城市绿线是指城市各类绿地范围的控制线。
第二十八条市规划主管部门应当会同市绿化主管部门依据本市城市绿地系统规划，对已建成的城市绿地和规划确定的城市绿地以及其他对城市景观、生态产生积极作用需要控制的区域，划定城市绿线，报市人民政府批准，并自批准之日起三十个工作日内报市人大常委会备案。
市绿化主管部门应当建立城市绿线档案，定期开展城市绿地资源调查，及时补充更新城市绿线档案。
依法划定并经市人民政府批准的城市绿线应当向社会公布，并接受监督。
第二十九条任何单位和个人不得侵占、破坏城市绿地;不得买卖、转让、租赁或者抵押公园绿地、居住区绿地、防护绿地、生产绿地和道路绿地。单位附属绿地在单位土地使用权转让、租赁或者抵押时，不得改变绿地性质或者减少绿地面积。
在城市绿地内，不得进行与绿地管理、养护无关的任何建设活动或者其他占用绿地活动。
已建成公园绿地的地下空间禁止商业开发。
第三十条已建成的城市绿地和规划确定的城市绿地应当作为城市总体规划的强制性内容，不得擅自变更。
因市政基础设施等公益性建设项目确需占用城市绿地，调整城市绿线的，市绿化主管部门应当会同市规划主管部门组织有关部门和专家进行评估，并采取论证会、听证会或者其他方式征求公众意见，由市人民政府提出，市人大常委会审议后，按照修改和调整城市总体规划有关程序的规定，报城市总体规划原批准机关审批。
依法调整的城市绿线应当向社会公布并接受监督。
第三十一条对已建成城市绿地内的.违法建筑物、构筑物及其他设施和超过临时占用城市绿地期限的，人民政府应当组织限期拆除，恢复绿地功能。
第三十二条因城市建设或者其他特殊情况，需要临时占用城市绿地的，应当向市绿化主管部门提出申请，经批准后实施。
临时占用期满后，占用单位应当及时清场退地，由园林绿化管理机构按照原标准或者高于原标准进行恢复。
临时占用绿地期限一般不超过一年;确需延长的，应当向原批准机关申请办理延长手续，延长期限最长不超过一年。
第三十三条因依法调整城市绿线占用绿地的，占用单位应当缴纳绿地补偿费。收取绿地补偿费的具体办法由市人民政府规定。
经批准临时占用城市绿地的，占用单位应当缴纳绿地恢复费。
绿地补偿费和绿地恢复费由市绿化主管部门按照自治区价格主管部门批准的标准统一收取，由市财政部门专项存储，用于补建、增加和恢复绿地。
第三十四条在绿地范围内，禁止下列行为：
(一)挖砂取土，搭建建筑物、构筑物;
(二)践踏草坪，损坏绿化设施;
(三)倾倒垃圾、有害废渣、油类，排放污水，堆放含有融雪剂的积雪、杂物;
(四)在绿地内停放车辆或者利用绿化用水清洗车辆;
(五)放养家禽、家畜、宠物，打鸟;
(六)擅自用火，燃放烟花爆竹;
(七)其他损坏绿地的行为。
第三十五条禁止下列损坏城市树木的行为：
(一)在树木旁或者树坑内用火、堆放杂物，或者向树木根部倾倒危害树木生长物质;
(二)在树木上涂、写、刻、画，擅自悬挂、张贴广告或者其他物品;
(三)攀、折、钉、拴树木;
(四)除紧急抢修临时搭建围挡外，在树木一米范围内搭建施工围挡以及五米内设置广告牌;
(五)其他影响树木正常生长的行为。
